Mesa, Arizona - As the holiday season approaches, Mesa city officials are reminding residents to be mindful of the rules and regulations surrounding the sale and use of fireworks. With the aim of ensuring a safe and enjoyable celebration, the city has set specific dates and times during which fireworks can be purchased and ignited.

According to the Mesa City Code pertaining to fireworks and permissible consumer fireworks, legal fireworks are available for sale in Mesa until January 3rd. The authorized use of these fireworks starts on December 26th and continues until January 4th. However, there are specific time restrictions in place. Fireworks can be used between the hours of 8 a.m. and 11 p.m., except on December 31st when the use is permitted until 1 a.m. on January 1st.

The recent changes to the fireworks regulations were brought about by the passage of Arizona House Bill 2255, which became law on October 30th. This bill aims to ensure the safe and responsible use of fireworks during the holiday season.

It is important to note that not all fireworks are legal during this period. Mesa authorities have outlined the types of fireworks that are allowed for use. Ground spinners, sparkling wheel devices, and various fountain-shaped fireworks, such as cylindrical, square, cone, and California rocket-shaped fountains, fall within the permissible category. However, it is crucial to be aware that certain fireworks are strictly prohibited. These include bottle rockets, firecrackers, roman candles, aerials, and single tube devices.

City officials have also emphasized the penalties associated with the sale and use of illegal fireworks. In 2022, the Mesa City Council approved changes that created criminal penalties for selling and using illegal fireworks, as well as updated civil penalty fines. Violations can result in fines ranging from a minimum of $500 for offenses such as using permissible fireworks outside of the allowed days and times, to a minimum of $1,000 and up to $2,500 for a class 1 misdemeanor, which may also carry a jail sentence of up to 6 months.

Mesa Fire and Medical Department Deputy Chief, Mike Dunn, urges residents to comply with the regulations to ensure public safety. Dunn stated, "We want everyone to have a safe and enjoyable holiday season. By following the guidelines set forth by the city, we can all contribute to a festive atmosphere without compromising the well-being of our community."

To further clarify the rules, the city has provided a comprehensive guide in Title 6, Chapter 21 of the Mesa City Code. This resource contains detailed information about the sale and use of fireworks, ensuring that residents have access to the necessary information to celebrate responsibly.

As the holiday festivities approach, Mesa residents are encouraged to take note of the regulations regarding fireworks. By adhering to the designated sale and use dates, as well as the approved types of fireworks, individuals can avoid civil and criminal penalties and contribute to a safe and joyous holiday season for all.
